TheMichiganCourtofAppealshasrecentlyissuedadecisionofwhichABCmembersmustbeaware.Thecourtruledthatindividualswhoholdavalidmedicalmarijuanaregistryidenticationcardcancollectunemploymentbenetseventhoughtheytestpositiveformarijuanaduringadrugtest.ThecaseisBraskavChallengeManufacturingCompanyCourtofAppealsDocketNo.313932decidedOctober232014.TheMichiganMedicalMarihuanaActMMMAprovidescertainimmunitiesfromarrestprosecutionorpenalty.Section4oftheActprovidesinpertinentpartAqualifyingpatientwhohasbeenissuedandpossessesaregistryidenticationcardshallnotbesubjecttoarrestprosecutionorpenaltyinanymannerordeniedanyrightorprivilegeincludingbutnotlimitedtocivilpenaltyordisciplinaryactionbyabusinessoroccupationalorprofessionallicensingboardorbureauforthemedicaluseofmarihuanainaccordancewiththisactMCL333.26424aemphasisaddedIncontrasttheMichiganEmploymentSecurityActMESAprovidesthatanindividualmaybedisqualiedfromreceivingunemploymentbenetsundertheprovisionsofSection291miftheindividualisdischargedForillegallyingestinginjectinginhalingorpossessingacontrolledsubstanceonthepremisesoftheemployerrefusingtosubmittothebloodtestthatwasrequiredtobeadministeredinanon-discriminatorymannerortestingpositiveonadrugtestifthetestwasadministeredinanon-discriminatorymanner.MCL421.291mThecaseinvolvedthreeseparateindividualswhohadbeendeniedbenetsbytheMichiganCompensationAppellateCommissionMCAC.Eachunemploy-mentclaimantappealedtotheappropriatecircuitcourt.ThecircuitcourtineachcasereversedtheMichiganAppellateCommissionandfoundthattheindividu-alsshouldnotbedisqualiedfromreceivingbenets.Eachcircuitcourtuseddifferentreasoningtondtheclaimantsqualied.TheCourtofAppealsafrmedthecircuitcourtdecisions.AfterreviewingboththeMMMAandtheMESAtheCourtofAppealsconcludedthattheforfeitureofunemploymentbenetsundertheMESAconstitutedanimpermissiblepenaltyundertheMMMA.AccordinglytheCourtofAppealsfoundeachoftheindividualclaimantstobeentitledtounemploymentbenets.TheCourtofAppealsindicatedthattoreviewandresolvetheinterplaybetweentheMESAandtheMMMAthecourtmustdeterminewhethertheclaimantsmetthethresholdrequirementsforreceiptofunemploymentcompensationbenetswhethertheywereneverthelessdisqualiedforunemploymentbenetsundertheMESAsdisqualicationprovisionsandthentheextenttowhichtheMMMAotherwiseprovidesimmunityandpre-emptsdisqualicationundertheMESA.ThecourtfoundthattheimmunityprovidedunderMCL333.26424awasbroad.UndertheimmunityprovisionstheMMMAprohibitstheimpositionofcer-tainconsequencesuponindividualswhousemedicalmarijuanainaccordancewiththeMMMA.Thecourtconcludedthatthedenialofunemploymentbenetsconstitutedtheimpositionofapenalty.WeconcludethatdenialofunemploymentbenetsimposedunderSection291mconstitutesapenaltyundertheMMMAthatwasuponclaimantsfortheirmedicaluseofmarijuana.SlipOp.pg.11ThecourtwentontostateBecauseclaimantsusedmedicalmarijuanatheywererequiredtoforfeittheirunemploymentbenets.ForthisreasonthedecisionbytheMCACtodenyclaimantsunemploymentbenetsamountedtoapenaltyimposedforthemedicaluseofmarijuanacontrarytoMCL333.264241.IneachofthesecasestheonlyquestionwasthequestionofwhethertheindividualsshouldbedisqualiedunderthepositivedrugtestprovisionsoftheUnemploymentMESAstatute.Thecourtsdidnotdiscusswhetherdisqualicationunderthemisconductprovisionsshouldalsohavebeenconsidered.Whilewedonotknowhowthecourtsmayultimatelyaddresstheissueofmisconductcontractorscantakethefollowingstepstoassurethattheirpoliciesproperlyreectanydruguseasadisregardoftheemployersinterest.Druguseandtestingpoliciesshouldbereviewedbyaqualiedemploymentlawattorney.Druguseandtestingpoliciesshouldreectthatanypositivedrugoralcoholtestisconsideredunacceptableforhealthandsafetyreasonsandwillleadtopossibledisciplinaryaction.Druguseandtestingpoliciesshouldreectthatmedicaluseofmarijuanawillnototherwiseexcuseanindividualfromtheconsequencesofapositivedrugtest.Apositivedrugandalcoholtestisconsideredcontrarytothemaintenanceofahealthyandsafeworkenvironmentandcontrarytotheexpressedinterestsoftheemployertomaintainahealthyandsafeworkenvironment.PleasecontactMasudLaborLawGroupforassistance.www.abcgmc.orgTheTRANSIT17GaryPattersonMasudLaborLawGroupCourtofAppealsApprovesUnemploymentBenetsforIndividualsWhoFailDrugTest
